Jeffrey represented myself and many others in a class action lawsuit against Aureate (name later changed to Radiate) in March 2000, seeking an injunction to cease distributing its adware/spyware in shareware software applications, as well as damages resulting from the alleged theft of private information by same product.

The company had very limited assets and eventually went out of business defending itself, but Jeffrey was able to pursue the claim against its insurance carrier which eventually paid a large monetary settlement in February 2005.

Jeffrey’s dogged persistence, patience and skill overcame difficult legal and financial barriers, resulting in our eventual success. This was the first time a claim of trespass against property was used successfully in this legal context, and it set a precedent for future claimants.
